LOGAN, W.Va. — A local occurrence which reached national attention has taken another turn: candidate for state senate Richard Ojeda has filed a civil suit against a man which attacked him just days before the May 10, 2016 primary elections.

The altercation and the subsequent news with which it was associated reversed a trend in early voting which had Ojeda’s opponent in the lead.

Jonathan Porter was later arrested by the West Virginia State Police for the assault and is currently incarcerated at the Southwestern Regional Jail in Holden, W.Va.

Documents filed in Logan Count Circuit Court in late September by Ojeda say both men attended a political event where Porter” …battered plaintiff with his fists and or other objects.”

The document goes on to allege Ojeda suffered multiple facial fractures along with other injuries and was required to undergo medical treatment.

The documents state Ojeda, “…has suffered great pain of body and mind, medical expenses, lost wages, loss of ability to enjoy life, permanent physical disability, mental anguish, annoyance and inconvenience…”

In recompense for Ojeda’s medical bills and the list of other complaints, he is seeking payments which exceed the jurisdictional amount of the court.

The documents filed by Ojeda say he seeks, “…punitive damages in such amounts as are reasonably necessary to discourage such future conduct on the part of the defendant, and that he be awarded his costs and that he granted such other and further relief as the nature of his case may require.”
