Danville man alleges misconduct by several county officials

MADISON -- About a year and a half ago, David Richard Stollings was charged by the Boone County Sheriff’s Department in connection with a shooting of another Boone County man as well as for assaulting another local woman. In January of this year, Stollings said all the charges were dismissed. “I acted in self-defense and they had no case against me,” Stollings said. “The deputy charged me with drug dealing because his girlfriend was involved with this case. There were no narcotics involved.” Stollings was charged in January of this year with forced entry into a woman’s home allegedly in April of last year, however the court documents show that the officer signed the criminal complaint in April. “I didn’t even know the charges existed until January of this year,” Stollings said. “I have a notarized statement from the woman that she has filed no charges, nor has she accused me of any such crime. I did not break into her home. I had a key and her permission to get my washer and dryer out of her house, but I was still arrested for breaking and entering.” Stollings said the only witnesses against him in this case are criminals “trying to buy their way out of trouble.” On Tuesday, March 5th, Stollings, 54, of Danville, appeared before the Boone County Commission to speak during the public comments portion of the agenda of the commission’s regular session meeting. “I am addressing the county commission today because of the misconduct of two Boone County deputy sheriffs, one Boone County magistrate and a Boone County Assistant Prosecuting Attorney,” Stollings said. Stollings said he came to county commissioners because he feels they also have the power to investigate his allegations. “I have filed complaints with the West Virginia Ethics Commission and the Judicial Investigation Commission. I thought about filing a complaint with the Boone County Sheriff’s Department,” he said. “However, current Sheriff Randall White is a former deputy and has worked with these men, so I felt it necessary to file my complaint in Charleston. I have nothing against the current Sheriff and feel he is doing a good job and I didn’t want to burden him with this case that happened before he became Sheriff. ” Stollings charges the deputies, the magistrate and prosecutor with false arrest, false imprisonment and defamation of character. “I will no longer tolerate it,” he said. “I have lived here all my life and a retired coal miner with over 30 years in the UMWA. I do not steal and I do not deal drugs.” Stollings identified Boone County Magistrate Charles Byrnside, Boone County Assistant Prosecuting Attorney Justin Marlowe and Deputies Josh Weagle and Jeffrey Pauley in his misconduct complaint. “Magistrate Byrnside and Assistant Prosecuting Attorney Marlowe apparently have a personal vendetta against me and a hidden agenda,” Stollings told commissioners. “I did nothing wrong. I am taking these actions because these people are ruining my life. I am not going to be persecuted any longer.” Stollings claims that he has retained a Huntington lawyer to represent him with his lawsuits he plans to file against the two deputies, but declined to give the name of the attorney. The commission did not respond to Stollings complaint. Assistant Prosecuting Attorney Justin Marlowe was also at the commission meeting and declined comment after the session was over.
