Larry McKinney, of Orgas, spent his 41st birthday at the Southwestern Regional Jail after he was arrested on July 11 on charges of a third offense DUI, or driving under the influence of alcohol.

According to a criminal complaint filed in the magistrate court of Boone County, Deputy E.E. Arthur and Deputy J.R. Dalton, of the Boone County Sheriff’s Department, were dispatched to Keith, W.Va. in reference to a reckless driving complaint.

The officers were advised that a red Chevrolet blazer with a white door was spinning out and causing a disturbance, according to the complaint.

McKinney’s vehicle was stopped and McKinney told the officer that he had been drinking and was in possession of an alcoholic beverage, according to court documents.

McKinney failed three standardized field sobriety tests and was placed under arrest and transported to the Madison Police Department.

McKinney was released on a $20,000 surety. If found guilty, he faces one to three years in jail, plus a $3,000 to $5,000 fine.
